Construction in South Africa today is a challenge for contractors, subcontractors, quantity surveyors, architects and project managers to mention a few.

At Allardyce and Partners we understand that getting paid on time is essential for cash flow and to ensure the viability and profitability of projects. We also understand that no project is without its problems, and regrettably sometimes legal assistance is required.

With this in mind we offer the following. You can register with us as a client and pay a nominal monthly retainer fee. The fee will depend upon the size of your business, the number of disputes you have and contracts currently in place.

 

What do you get for this?

  1. We will ensure that the jobs that you have been awarded are properly regulated in the appropriate form of contract, JBCC, NEC3, Fidic to name a few, and that we have a copy of that contract on file for you so that is it accessible to us should you need telephonic advice.

 

  1. We will provide you with advice on how to ensure that your interests are protected at all times in respect of pre-existing claims and disputes as well as any disputes and claims in the future.

 

  1. In the event that there are claims, we shall assist you with the drawing up of notices in terms of the relevant provisions of the agreement.

 

  1. The purpose of the retainer agreement is to establish a relationship between our professionals and your business so as to avoid the pitfalls of the construction industry and crisis management.

 

Flexible fee arrangements.

We are also aware that occasionally you are required to escalate a claim to the level of the dispute whether it be adjudication or arbitration. To assist clients we offer a flexible fee arrangement which provides a combination of contingency arrangements and hourly rates. A contingency arrangement is one where we agreed to undertake the work on your behalf and if we are not successful and you do not get paid, we do not get paid.

The reason why we offer this arrangement to our clients is to enable clients to litigate in circumstances where it would otherwise be difficult to do so because of the prohibitively high cost of legal fees.
